What Happens to the Extra Money After a Florida Foreclosure Sale?

When a home sells at a foreclosure auction for more than what was owed on the final judgment, the difference is called foreclosure surplus, and under Florida law it doesn't belong to the bank or the court. Here's the full journey of that money, and why moving fast matters.

  1. Auction day

    The home sells for more than what was owed to the bank

    At the foreclosure auction, the winning bid often exceeds the final judgment amount, which is what the court determined was owed to the lender plus costs. The lender receives only what the judgment entitles it to. The rest, called the surplus, is deposited into the court registry with the Clerk of Court (Sections 45.031 and 45.032, Florida Statutes).

    Example:Sold for $250,000$180,000 final judgment=$70,000 surplus
    What this means for you: The bank does not keep the extra money. This is the single biggest misconception about foreclosure. The lender is paid what it is owed, nothing more.
  2. Shortly after the sale

    The surplus becomes official, but you may never hear about it

    The Clerk issues a certificate of disbursements showing the exact surplus amount. Notices go to the addresses in the court file, which is often the foreclosed property itself or an old address from years of litigation. People who just lost their home and moved rarely receive them.

    What this means for you: Not receiving a letter does not mean there's no money. Many Floridians have surplus sitting in the court registry and were never successfully notified.
  3. After the surplus is deposited

    Claims are decided by the court, and speed matters

    The former owner and any subordinate lienholders, such as second mortgages, HOA liens, or judgment creditors, file claims in the foreclosure case, and the court orders who gets paid. The owner of record is legally presumed entitled to whatever remains after timely lienholder claims. Here is why speed matters: if the court disburses the surplus to you before any lienholder files a claim, that payment is final. A lienholder who files too late cannot take the surplus back from you.

    What this means for you: There is no waiting period that protects latecomers. Filing your claim quickly and correctly can mean receiving the full surplus instead of sharing it.
  4. After claims are filed

    Owner or heirs claim processing

    The court reviews the claims and enters a disbursement order. If competing claims exist, the court holds a hearing to decide entitlement. If the owner has passed away, legal heirs can claim with documentation proving heirship. A complete, properly documented claim is what gets the funds released.

    What this means for you: Losing the home did not erase your right to this money. Incomplete paperwork is the most common reason claims stall. We prepare and file everything correctly the first time.
  5. 1 year after the sale

    Unclaimed surplus is sent to the State of Florida

    This deadline is written directly into Florida law (Section 45.032, Florida Statutes). One year after the sale, any surplus still held by the Clerk is presumed unclaimed and is reported and remitted to the state's unclaimed property program, unless a court proceeding about the funds is pending. After the transfer, only the former owner of record or the beneficiary of a deceased owner can claim the funds, and the process becomes slower and more complex.
