What Happens to the Extra Money After a Florida Tax Deed Sale?

When a property sells at a tax deed auction for more than the taxes and costs owed, the difference is called tax deed surplus, and under Florida law it doesn't belong to the county. Here's the full journey of that money, and where the deadlines are.

  1. Auction day

    The property sells for more than what was owed

    At a public tax deed auction, bidders compete for the property, and the winning bid often exceeds the unpaid taxes, interest, and sale costs. That extra amount, called the surplus, is deposited with the Clerk of the Circuit Court in the county where the property was located (Chapter 197, Florida Statutes).

    What this means for you: the money is sitting in a county account, in your name, but the Clerk will not track you down to hand it over. Someone has to claim it.
  2. Shortly after the sale

    Notices are mailed, often to outdated addresses

    The Clerk mails a notice of surplus funds to the former owner of record and to lienholders. In most cases, those notices go to the property address and to the tax mailing address on file with the Property Appraiser, and those records are frequently outdated. If you've moved, or never updated the mailing address, the notice simply never reaches you.

  3. 120 days from the notice

    The lienholder claim window runs, but owners shouldn't wait

    Lienholders have 120 days from the Clerk's notice to file claims against the surplus (§ 197.582, Florida Statutes). As the former owner, you can and should file your claim during this window too. The county will hold it and wait until the full 120 days pass before processing owner claims, but filing early means your claim is first in line the moment the window closes. Don't waste this time.

  4. After the window closes

    Owner or heirs claim processing

    Once the 120-day window ends, the Clerk reviews and processes claims. After any valid lienholder claims are paid by legal priority, the remaining surplus is payable to the former owner of record or, if the owner has passed away, to their legal heirs with documentation proving heirship. A complete, properly documented claim is what gets the funds released.

    Counties don't hold unclaimed surplus forever. The timing varies by county, but many transfer unclaimed funds to Florida's unclaimed property program after just one year. The money can still be recovered from the state, but the process becomes slower and more complex than claiming directly from the county.
